Ferrario Police Board Hearing and Dismissal
-
Description
-
The Board of Police Commissioners conducted administrative hearings and found Joseph Ferrario guilty of multiple department rule violations (including careless discharge of a firearm and submitting a false report). He was formally terminated from the force.
Ferrario v. Baer: Ferrario appealed his termination, arguing procedural due process violations because the board members who made the final decision had reviewed the written record rather than hearing all testimony live.
In December 1987, the court affirmed the dismissal, ruling that administrative boards are legally permitted to determine witness credibility and render disciplinary decisions after reviewing a complete hearing record without violating due process.
